These terms and conditions ("Terms", "Agreement") are an agreement between the mobile application developer and owner INNOVO DEV S.R.L. ("we," "our," or "us") and you ("User", "you" or "your"). This Agreement sets forth the general terms and conditions of your use of the VPD Chart web and mobile applications and any of its products or services (collectively, "Mobile Application" or "Services").
By accessing or using our Service, whether through our website at vpdchart.com or our iOS mobile application, you agree to be bound by these Terms of Use ("Terms"). If you do not agree to these Terms, please do not use the Service.
By downloading, installing, accessing, or using our Service in any manner, you acknowledge that you have read, understood, and agree to be bound by these Terms, our Privacy Policy, and any additional terms and conditions that may apply to specific features of the Service.
We reserve the right to modify these Terms at any time. Any changes will be effective immediately upon posting on the Service. Your continued use of the Service following the posting of revised Terms indicates your acceptance of such changes.
vpdchart.com provides tools for calculating Vapor Pressure Deficit (VPD) utilizing air temperature, air relative humidity (RH), and canopy temperature. The Service generates VPD charts and displays VPD values for agricultural and horticultural applications.
You are responsible for maintaining the security of any device on which you use the Service. We cannot and will not be liable for any loss or damage arising from unauthorized access to the Service through your device.
You agree not to:
a) Use the Service for any illegal purpose or in violation of any local, state, national, or international law;
b) Violate or encourage others to violate the rights of third parties, including intellectual property rights;
c) Upload, transmit, or distribute any computer viruses, worms, or any software intended to damage or alter a computer system;
d) Interfere with, disrupt, or create an undue burden on the Service or the networks or services connected to the Service;
e) Attempt to gain unauthorized access to the Service, other users' devices, computer systems, or networks connected to the Service;
f) Harvest, collect, or gather user data without permission;
g) Use the Service in any manner that could disable, overburden, damage, or impair the Service;
h) Use any robot, spider, or other automatic device, process, or means to access the Service for any purpose;
i) Introduce any malware, viruses, Trojan horses, worms, logic bombs, or other harmful material to the Service;
j) Reverse engineer, decompile, disassemble, or otherwise attempt to derive the source code of the Service or any part thereof.
The Service and its original content, features, and functionality are and will remain the exclusive property of INNOVO DEV S.R.L. and its licensors. The Service is protected by copyright, trademark, and other intellectual property laws.
Subject to these Terms, we grant you a limited, non-exclusive, non-transferable, and revocable license to use the Service for your personal, non-commercial use only.
Any data or configurations you create while using the Service (such as custom chart configurations or manually entered data) are stored locally on your device. You retain ownership of this data. In cases where sensor integration features are used, relevant measurement data may be transmitted as necessary for the functionality of the Service.
The Service may allow integration with third-party sensors or devices. We are not responsible for and do not endorse the content, accuracy, or practices of such third parties. Your use of such integrations is at your own risk.
The Service may contain links to third-party websites or services. We are not responsible for the content or practices of any linked websites or services. We provide these links solely for your convenience, and the inclusion of any link does not imply endorsement by us.
We collect and process personal information in accordance with our Privacy Policy. By using the Service, you consent to our data practices as described in the Privacy Policy.
The Service may store configuration data locally on your device. This data remains on your device and is not automatically transmitted to our servers unless specifically configured for sensor integration features.
While we strive to provide accurate VPD calculations and visualizations, you acknowledge that the accuracy of results depends on the accuracy of input data. We do not guarantee the accuracy of calculations based on sensor readings or manual inputs.
The iOS mobile application offers both free and premium features accessible via subscription. By selecting a paid subscription within the iOS app, you agree to pay all applicable fees.
For iOS app subscriptions, you will be billed through your Apple ID account on a recurring basis, depending on the subscription type selected. You authorize Apple to charge your chosen payment method associated with your Apple ID.
You may cancel your iOS app subscription at any time through your Apple ID account settings. Cancellations will take effect at the end of the current billing cycle, and no refunds will be provided for partial billing periods unless otherwise required by applicable law.
We reserve the right to adjust pricing for our Service or any components thereof at our sole discretion. Any price changes will be communicated to you in advance through the App Store.
THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING, BUT NOT LIMITED TO, IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED OR ERROR-FREE, THAT DEFECTS WILL BE CORRECTED, OR THAT THE SERVICE OR THE SERVERS THAT MAKE IT AVAILABLE ARE FREE OF VIRUSES OR OTHER HARMFUL COMPONENTS.
IN NO EVENT WILL INNOVO DEV S.R.L., ITS AFFILIATES, OR THEIR LICENSORS, SERVICE PROVIDERS, EMPLOYEES, AGENTS, OFFICERS, OR DIRECTORS BE LIABLE FOR DAMAGES OF ANY KIND, UNDER ANY LEGAL THEORY, ARISING OUT OF OR IN CONNECTION WITH YOUR USE OF THE SERVICE, INCLUDING ANY DIRECT, INDIRECT, SPECIAL, INCIDENTAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING BUT NOT LIMITED TO, PERSONAL INJURY, PAIN AND SUFFERING, EMOTIONAL DISTRESS, LOSS OF REVENUE, LOSS OF PROFITS, LOSS OF BUSINESS OR ANTICIPATED SAVINGS, LOSS OF USE, LOSS OF GOODWILL, LOSS OF DATA, AND WHETHER CAUSED BY TORT (INCLUDING NEGLIGENCE), BREACH OF CONTRACT OR OTHERWISE, EVEN IF FORESEEABLE.
You agree to defend, indemnify, and hold harmless INNOVO DEV S.R.L., its affiliates, and their respective officers, directors, employees, contractors, agents, licensors, and suppliers from and against any claims, liabilities, damages, judgments, awards, losses, costs, expenses, or fees (including reasonable attorneys' fees) arising out of or relating to your violation of these Terms or your use of the Service.
You may terminate your use of the Service at any time by discontinuing use of the applications. For iOS app subscriptions, you may cancel your subscription through your Apple ID account settings.
We may terminate or suspend your access to the Service immediately, without prior notice or liability, for any reason, including if you breach these Terms. Upon termination, your right to use the Service will immediately cease.
Upon termination of your access to the Service, any data stored locally on your device will remain until you delete the application. We are not responsible for the loss of any data resulting from termination of access.
These Terms shall be governed by and construed in accordance with the laws of the jurisdiction where INNOVO DEV S.R.L. is registered, without regard to its conflict of law provisions.
Any dispute arising from these Terms shall be resolved through arbitration in accordance with the rules of the arbitration association in the jurisdiction where INNOVO DEV S.R.L. is registered.
You agree to comply with all applicable export control laws and regulations in your use of the Service.
We reserve the right to withdraw or amend the Service, and any service or material we provide via the Service, in our sole discretion without notice. We will not be liable if for any reason all or any part of the Service is unavailable at any time or for any period.
If any provision of these Terms is held to be invalid or unenforceable, such provision shall be struck and the remaining provisions shall be enforced to the fullest extent under law.
These Terms, together with the Privacy Policy and any other legal notices published by us on the Service, constitute the entire agreement between you and us regarding your use of the Service.
No waiver of any term of these Terms shall be deemed a further or continuing waiver of such term or any other term, and our failure to assert any right or provision under these Terms shall not constitute a waiver of such right or provision.
